Berwyn resident Jose Giancarlo Difatta-Perez, 31, has been charged with first-degree murder of his 10-month old niece, Giselle Estaphanie Cueller, according to authorities.
Difatta-Perez appeared in court on Wednesday, Aug. 5 and was denied bail by Cook County Circuit Court Judge Ramon Ocasio III after admitting that he shook the child when she was under his supervision on Saturday, July 18, according to Steve Campbell of the Cook County state’s attorney’s office.
The infant was at her mother’s house when she left her under Diffata-Perez’s care. Hours after she was already out, Diffata-Perez called the mother to inform her that the infant woke up from a nap and that something was wrong, according to Campbell.
The mother immediately returned home to find her daughter “motionless,” and said that she could hear her baby gasping for air on her phone call with Diffata-Perez, according to Campbell.
Berwyn police arrested Diffata-Perez after speaking with the Cook County medical examiner’s office, according to a report from the Tribune.
“On behalf of Mayor Robert Lovero and the Berwyn Police Department, our thoughts, prayers, and support go out to the Cuellar family,” according to a statement from the police department.
The next court date is set for Friday, Aug. 21, according to Campbell.
